What a legal notice does
A legal notice is a formal written demand for payment. It shows the debtor you are serious, sets a clear deadline and creates evidence that payment was requested before any court action.
What to include
- Names and details of creditor and debtor.
- The amount due and how it is calculated.
- The basis: contract, invoices, cheques or acknowledgements.
- A clear deadline for payment.
- The action that will follow if payment is not made.
How it is sent
Notices are usually prepared by a lawyer and delivered in a way that can be proven, for example through official notification channels or trackable delivery.
If the debtor ignores it
The next step is usually a court claim or, for an enforceable instrument such as a dishonoured cheque, an application to the enforcement judge.
